e-Signature registers

According to Act 35 of 2001 on electronic signature (Eat.) and Government Decree No. 45/2005. (III. 11.) on the National Communications Authority's electronic signature related responsibilities and powers and the detailed rules of its procedure (Decree) NCAH keeps and publishes the following registers:

Non-qualified services

A natural person with permanent or temporary residence in Hungary or a legal person or organisation without legal entity with registered offices (premises) in Hungary starting the performance of non-qualified service must within 30 days of starting the service give a notification thereof to the Authority (Article 7 (1) of Eat.).

Qualified services

A natural person with permanent or temporary residence in Hungary or a legal person or organisation without legal entity with registered offices (premises) in Hungary starting the performance of qualified service must within 30 days of starting the service give a notification thereof to the Authority (Article 7 (1) of Eat.). and make a statement on whether it intends to pursue such activity as a qualified service provider (Article 7 (3) of Eat.). The detailed rules applicable to the service providers are laid down in Decree No. 3/2005. (III. 18.) IHM on the detailed requirements applicable to the service providers and detailed requirements applicable to electronic signature related services and their providers.

Certified electronic signature products

Signature device: means hardware or software used by the signatory to create the electronic signature with the signature creation data. Electronic signature product: means hardware or software or other component connected with the electronic signature application that can be used for the provision of electronic signature related services and for the creation or verification of electronic signatures or time stamp (Articles 2 (3) and 11 of Eat.).

Designated certification bodies

Designated certification body: means a person or organisation authorised to certify the conformity of the electronic signature product according to its designation (Article 2 (c) of Decree No. 9/2005. (VII. 21.) IHM on the bodies performing certification of electronic signature products and their designation).

Responsibility for certificates issued by foreign Certification Service Provider

The Authority registers the assumption of liability as defined in Article 5 (4) to (6) of Eat. connected with the certificate issued by a certification service provider with registered offices or permanent residence abroad (hereinafter referred to as ?foreign?) and publishes a register thereof that is accessible to anyone and continuously available (Article 4 (1) of the Decree).

Experts

The National Communications Authority issues expert?s licenses defined in Decree No. 7/2002. (IV.26.) MeHVM on the registration of electronic signature related service experts and keeps a register of experts and makes is electronically accessible to anyone with continuous availability.

Certification Service Providers and Certificate Policies for public administration

Electronic signatures for use in public administration are stipulated by Government Decree No. 194/2005 (IX. 22.) on the requirements of electronic signatures and certificates used in (actions of) public administration and Certification Service Providers issuing those certificates. The tables below depict Certification Service Providers issuing certificates for both qualified and advanced electronic signatures that can be used in actions of public administration.
